Background
The Act received Royal Assent on 3 April 2025, and it is expected that the implementation period will be at least 24 months from this date, enabling those responsible for premises and events to have sufficient time to understand their new obligations, and to plan and prepare accordingly. This also allows time for the new regulator function of the Security Industry Authority (SIA) to be established. Whilst there is no legal requirement to comply with the legislation until it comes into force, those that fall into scope may wish to begin considering what they need to do before commencement.
The Home Office published statutory guidance on 15 April 2026, which will assist those responsible for premises or events in scope to understand the requirements set out in the legislation and prepare for commencement. As stated in the guidance, the government’s intent is that those responsible for premises and events in scope can comply with the Act without needing to buy specialist services in respect of compliance. The Home Office and the SIA do not endorse any third-party products offered by the private sector in respect of compliance with this legislation.
The SIA, who will regulate Martyn’s Law, is developing its guidance, under section 12 of the Act, which explains how it plans to carry out its role as the regulator. At this event, the SIA will talk more about its planned approach to regulation and how organisations in scope can start to prepare to comply.
